Delta-8 has been sold nationally on the strength of the 2018 Farm Bill, which defined legal hemp by its delta-9 THC content — no more than 0.3% by dry weight. Delta-8 isn’t delta-9, so hemp-derived delta-8 fell outside that measurement. That’s the whole legal foundation.
